"He was born August 27, 1840 in Dahlonega, Lumpkin County, Georgia He married Harriet Elizabeth Newberry at Ticanetley Church, Gilmer County, Georgia. She wa the daughter of J. Earl Newberry and Mary J. Willis and was born 1849 in Georgia. She died in 1926 in Murphy, Cherokee County, North Carolina and is buried there in Ebenezer Cemetery.
"During the War between the states John Davis Joined F Company, 3rd Cavalry (USA), and was discharged in August, 1865. On June 13, 1870 he filed for a Federal pension in Morganton, Fannin County, Georgia. It was Granted and began July, 1871. He died January 12, 1906 and is buried at White Church Cemetery, Murphy, North Carolina.
Affadavit for Pension Application
J.P. Priest states that John Fricks' eyes became sore, but I do not remember the extent of the treatment for my recollection is that he always done his duty as a soldier and Sept. 26, 1864 in battle at Sulphur Trestle, Ala a ball or shell struck him under the foot. He was suffering then badly when I was hurried off south, a prisoner. In addition to the wound in the foot his collar bone was probably broken, but I did not examine him then. We were in camps together from March 1865 until muster out Aug. 3. 1865 and he complained of the disabilities as above set forth during this time. These facts are known to me because being in command of the company and being with him. I do not remember of the regimental surgeon Dr. Sours having treated him for as above stated my recollection is that he at all times and under all circumstances reported for duty even if he was sick. I have not seen the said John D. Fricks more than six times since our muster out - when his eyes got sore and we were on a raid into Miss. and the weather was extremely hard and we were without tents.
Elizabeth Dockery, Murphy N.C. swears that I am 30 years old and have been aquainted with John D. Fricks the deceased soldier who died on 12th Jan. 1906. That said John D. Fricks had accrued a pension due him for about 2 mos. and 8 days, that said John D. Fricks drew $24 per month and was paid from the Knoxville, Tenn Agency. That said pensioner had a child under 16 yrs of age the name child being Bessie May Fricks who is 11 yrs old the 22nd day of last Oct. I know her age because I was there when she was born and further that I know her age because I have a child six weeks older than the said Bessie May Fricks said miner child of John D. Fricks. That I have been aquainted with the soldier all my life and that he was married to Harriet Fricks because it was generally understood and reported that they were man and wife and live together as such until about two or three years ago. I was at the funeral when J.D. Fricks was buried and was also present when he died.
PERSONAL TESTIMONY OF JOHN D. FRICKS, aged 50 yrs. old a resident of Hanging Dog, Cherokee, N.C. while at Sulphur Mussel in Ala. on or about the 25 day of Sept. 1864 in battle a cannon ball struck a pine pole and knocked it with such force and the weight also of it falling on my shoulder broke the bone down which was never placed and is still badly out of shape and I have no strength in my right arm as consequence thereof. I was capyured by the rebels at the same time and carried out in the country and left at a private house from which I escaped. When my regiment left Nashville in the 1864 on what is called Smith's Raid into Miss. I contacted sore eyes. Both eyes are badly affected so that I am at times nearly blind but at times can see some better. Dr. Rich of Fannin Co. GA. treated me for the diseases stated in my pension claim and Dr. Bailey of Gilmer Co. Ga. treated me for about a yr. They are both dead to my own personal knowledge. At intervals since I was discharged from the service I have been unable to obtain the services of any physician. I treated myself all the time with elm-poultice and alum cond. and many other such remedies as was informed would be benificial to my eyes."
